Mr. Erickson, Thank you for your inquiry regarding disabled clam diggers. We had a lengthy discussion between ODFW staff and Oregon State Police up and down the Oregon Coast and determined that the current rule/permit regarding the distance between a disabled clam digger and their assistant warrants a change.
We will be proposing that the current rule/permit will be modified to state: A person may assist a disabled clam digger, provided the disabled clam digger is within 100 yards and within line of sight of the assistant while the assistant is digging.
All other rules that are currently in place will remain in effect.
This proposal will significantly increase the distance between the disabled clam digger and their assistant, providing them more flexibility when they are on or near the clamming beds. It will also provide OSP an appropriate enforceable regulation.
Ultimately, the Oregon Fish and Wildlife Commission will have to approve this proposal, staff will be presenting this proposal to the Commission as part of the 2020 Sport Fishing Regulation approval process.
